City of Bloomer

Regular Meeting of the Common Council

1503 Main Street

Bloomer, WI 54724

April 11, 2018, 6:00 p.m.

Pursuant to due call and notice thereof a public hearing of the Common Council of the City of Bloomer was held on Wednesday, April 11th at 6:06 p.m. to hear public comment regarding a conditional use permit application submitted by John & Audrey Sykora, 1403 9th Avenue and James & Brenda Jones, 1435 York Street to allow for keeping of chickens in an R-1 Single Family Zoning District.   There was no public to be heard for either application.  The public hearing was closed at 6:07 p.m.

Pursuant to due call and notice thereof a regular meeting of the Common Council of the City of Bloomer was called to order on Wednesday, April 11th, at 6:07 p.m. at City Hall, 1503 Main Street - Mayor Steinmetz presiding.

Roll call was taken:  Mayor Steinmetz, Aldermen Meinen, Hofmann, Jones, Koehler, Administrator Frion and Attorney Gustafson were all present. 

All present gave pledge to the flag.

Alderman Koehler made a motion to approve the minutes from the March 28th, 2018 meeting as presented.  Alderman Jones seconded the motion and all present voted aye. 

Alderman Hofmann made a motion to approve all claims against the City and Utilities as presented.  Alderman Meinen seconded the motion and all present voted aye. The claims were in the amounts listed below:

Kate Banchy, Spectrum Insurance Group, provided the Council information pertaining to HSA’s and how they would work for the City.  The City should be receiving quotes from 8 carriers for health insurance. 

Police Chief Zwiefelhofer has been approached by the ATV Club requesting to change the ATV speed limit to 25 mph.  The Club would be responsible for changing all the signs to reflect the change.  An ordinance amendment would need to come to a future meeting for approval.  Zwiefelhofer also has concerns with the location for the pedestrian crosswalk sign located on the corner of 17th Avenue and Riggs Street.  There is not a good spot for installing the pole on that corner.  Further review will have to be done on this issue prior to installing the pedestrian crosswalk.

Board of Review will be held on May 7th from 4-6 p.m. The City will be updating their financial software package in May.  A policy will come forward pertaining to direct deposit for payroll.  There will be an Active Shooter training session being held at the Library on April 26th at 6:30 p.m.

Alderman Jones and Koehler thanked those that were on the ballot in April for running and for their service.  Alderman Meinen mentioned that the parks will not be open on April 15th.  They will open pending the weather getting warmer.

Mayor Steinmetz commented that at the recent IDC meeting there was discussion pertaining to the availability of industrial property that the City has to offer. 

Alderman Hofmann made a motion to approve a conditional use permit as recommended by the Planning Commission for John & Audrey Sykora at 1403 9th Avenue with the conditions of an 8’x10’ coop and an 8’x20’ roaming area.  Alderman Koehler seconded the motion.  Motion carried.

Alderman Koehler made a motion to approve a conditional use permit as recommended by the Planning Commission for James & Brenda Jones at 1435 York Street with the conditions of a 4’x8’ coop and an 8’x8’ roaming area.  Alderman Jones seconded the motion.  Motion carried

Alderman Koehler made a motion to approve hiring a part-time seasonal employee for the 2018 summer.  Alderman Hofmann seconded the motion.  Motion carried.

Alderman Meinen made a motion approving the lease agreement with Marc Boettcher to rent the farm land in the Iron Horse Industrial Park for the amount of $2,450.  Alderman Jones seconded the motion.  Motion carried.

Alderman Koehler made a motion to approve allowing Southworth Chevrolet to install a 90 ft. flag pole at 2111 20th Avenue with the stipulation that they check with the FAA to see if they have any guidelines pertaining to the height.  Alderman Hofmann seconded the motion.  Motion carried.

Alderman Meinen made a motion to approve the rates charged for recycling of furniture at the Recycling Center.  Alderman Jones seconded the motion.  Motion carried.

Alderman Hofmann made a motion to approve a license to serve fermented malt beverages and intoxicating liquors for Joan Peterson, Roxanne Zwiefelhofer, Kaejan Pederson, and Donalee Harms.  Alderman Meinen seconded the motion.  Motion carried.

Discussion took place pertaining to the proposed agreement for repealing the ETZ ordinance.  Attorney Gustafson mentioned that the City does have insurance coverage for errors and omission of City officials.  The agreement would indemnify the Towns in the event they would incur some liability based on the decision of the City.  The agreement is strictly to proceed with the process of repealing the ETZ ordinance.

Alderman Jones made a motion to convene into closed session pursuant to Wis. Stat. 19.85 (1)(e) – “Deliberating or negotiating other specified public business, whenever competitive or bargaining reason require a closed session.”  - ETZ Repeal Agreement.   Roll call vote was taken.  Meinen – aye, Hofmann – aye, Jones – aye, Koehler – aye.

Alderman Koehler made a motion to reconvene to open session.  Alderman Meinen seconded the motion.  Roll call vote was taken.  Meinen – aye, Hofmann – aye, Jones – aye, Koehler – aye.

Alderman Meinen made a motion to approve the draft agreement authorizing the Mayor to sign it on behalf of the City based on the condition of both Towns approving the agreement.  Alderman Hofmann seconded the motion.  Motion carried.

Alderman Hofmann made a motion to convene into closed session pursuant to Wis. Stat. 19.85(1)(c) “Considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility.” – Performance evaluation and compensation of City Administrator/Clerk/Treasurer and review of reorganization and managers evaluations and compensation.    Alderman Jones seconded the motion.  Roll call vote was taken.  Meinen – aye, Hofmann – aye, Jones – aye, Koehler – aye. 

Alderman Koehler made a motion to reconvene to open session.  Alderman Meinen seconded the motion.   Motion carried.  No action was taken.

Motion by Alderman Hofmann to adjourn.  Alderman Koehler seconded the motion.  Motion carried.
