MEETING MINUTES

Bloomer, Wisconsin

                                                                               December 28, 2016

Pursuant to due call and notice thereof a regular meeting of the Common Council of the City of Bloomer was called to order on Wednesday, December 28, 2016 at 6:00 p.m. at City Hall, 1503 Main Street - Mayor Steinmetz presiding.

Roll call was taken:  Mayor Steinmetz, Alderpersons Meinen, Hofmann, Jones, Koehler, Clerk Stoik, Attorney Gustafson and Attorney Dale.

All present gave pledge to the flag.

Alderperson Koehler made a motion to approve the minutes from the previous meeting (December 14, 2016) as presented.  Alderperson Meinen seconded the motion and all present voted aye. 

Alderperson Hofmann made a motion to approve all claims against the City and Utilities as presented. Alderperson Meinen seconded the motion. Alderperson Jones questioned the MEUW voucher.  Mr. Paulson explained how the safety program is billed. All present voted aye. The claims were in the amounts listed below:

AUDIENCE COMMENTS

There were no audience comments.

Alderperson Meinen made a motion to approve the revised final rates for refuse (dumpster) charges effective January 1, 2017.  Alderperson Jones seconded the motion.  Michael Meindel, Street, Water & Sewer Administrator explained that after approval from the Council on November 30, 2016, they discovered some issue determining weight class. Action by the Council updates the problem and rounds the numbers as requested. All present voted aye.

Alderperson Hofmann made a motion to approve the Supplemental Letter Agreement with Short, Elliott & Hendrickson for 2017 Environmental Monitoring at the Bloomer Landfill for $5,900.  Alderperson Jones seconded the motion and all present voted aye.

Alderperson Hofmann made a motion to approve Police Chief Zwiefelhofer to attend the Supervisors Conference in Superior on Jan. 10-12, 2017.  Alderperson Koehler seconded the motion and all present voted aye.

Alderperson Meinen made a motion to approve changes to the quote for purchase of a garbage truck – total cost $185,991.  Alderperson Hofmann seconded the motion. This had been previously approved at the November 30, 2016 meeting.  Mr. Meindel explained that in the specs, a lift axle was not listed.  They need this with the weight they haul. The Common Council questioned the amount over the $180,000 budgeted.  Mr. Meindel stated they could transfer from the Machinery & Equipment designated funds to cover the overage.  All present voted aye.

DEPARTMENT HEADS

Peter Paulson, Electric Administrator - had nothing to report.

Michael Meindel, Street, Water & Sewer Administrator explained that he had received the parts to finish the dam leveling device located on the dam.  He will wait until early spring to have it installed, due to too much ice at this time.

Police Chief Jared Zwiefelhofer reported some of the parts for the installation of the pedestrian lights on 17th Avenue have arrived.  The Council questioned if he had been receiving complaints regarding the winter parking ordinance.  He stated that they have been ticketing violators and explaining the ordinances to residents. 

Fire Chief Brian Bleskacek stated the skating rink was open and they have been very busy.

ALDERPERSON COMMENTS

Alderperson Koehler reported the Recycling Center was very busy today and appreciated that there were two attendants.

Alderperson Jones stated he hoped that citizens would remember the elderly and disabled neighbors during the winter months.

Alderperson Hofmann – no comments.

Alderperson Meinen hoped citizens would be careful.  There is a lot of ice on the sidewalks.

Clerk Stoik – had nothing to report.

MAYOR COMMENTS

Mayor Steinmetz stated there would be a department head meeting on Thursday, Jan. 5th at 8 a.m.  He wished everyone a Happy New Year.

Attorney Mindy Dale explained at two prior meetings the Common Council discussed the procedure followed for the creation of City Administrator position and combining duties with that of the Clerk-Treasurer. Those agendas were specific enough and had sufficient discussion in open session.  But, if there were any questions regarding the procedure followed, the Common Council posted action at this meeting more specifically.  She summarized the pending retirements of existing staff, structure and supervisory authority.  Efficiencies are falling through the crack with the current structure.  In past closed sessions, strengths and weaknesses of existing staff were discussed.  In open session, they reviewed organizational structure and what would work for the City.  They also reviewed job descriptions, proposed timelines and required ordinance changes for proceeding with an Administrator-Clerk-Treasurer position.  She summarized the need at this meeting to have action regarding the job description, resolution to proceed, changes to the timeline, organizational chart, changes to other positions within the City and future ordinance changes.

Alderperson Meinen made a motion to approve the job description for Administrator – Clerk – Treasurer Position.  Alderperson Jones seconded the motion and all present voted aye.

Alderperson Koehler made a motion to approve Resolution 1155 – To Amend the City of Bloomer Code of Ordinances to Include a City Administrator – Clerk – Treasurer. Alderperson Hofmann seconded the motion and all present voted aye.

Alderperson Koehler made a motion to approve the timeline for the hiring of an Administrator – Clerk – Treasurer as explained by Attorney Dale with changes. Alderperson Jones seconded the motion and all present voted aye.

Alderperson Hofmann made a motion to approve the Organizational Chart with changes as proposed.  Alderperson Meinen seconded the motion and all present voted aye.

Discussion was held regarding changes to the existing positions in the city are needed.  Job descriptions need to be developed and future ordinances changes are needed.  

Transition issues associated with pending retirements of Michael Meindel, Street/Water/Sewer Utilities; Peter Paulson, Electric Utility; Sue Stoik, Clerk-Treasurer were discussed.  At this time, the Council will address these issues at a future meeting. 

Alderperson Meinen made a motion to go into closed session as authorized by Wis. Stats. 19.85(1) (c) for considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises authority and under Wis. Stats. 19.85(g) for conferring with legal counsel for the governmental body who is rendering oral or written advice regarding strategy to be adopted by the body with respect to litigation in which it is or likely to become involved, regarding:

            Compensation for employees performing transitional duties.

            Promotion and/or reassignment of employee(s).

            Retirement agreements to clarify benefits and transitional duties of retiring employees.

Alderperson Hofmann seconded the motion and a roll call vote was taken and a roll call vote was taken:  Alderperson Meinen, aye; Hofmann, aye; Jones, aye; Koehler, aye.

Alderperson Koehler made a motion to come out of closed session Wis. Stats. 19.85(1)  (c) & (g).  Alderperson Jones seconded the motion and a roll call vote was taken:  Alderperson Meinen, aye; Hofmann, aye; Jones, aye; Koehler, aye.

Attorney Dale explained no formal action was taken in the closed session.  Discussion was held regarding the retirement agreements for the existing staff.  Reassignments for Department Managers in the Street, Water & Sewer and Electric Departments will be handled once the job descriptions have been finalized.

Alderperson Jones made a motion to go into closed session as authorized by Wis. Stats. 19.85(1) (e) for deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining s reasons require a closed session. Alderperson Koehler seconded the motion and a roll call vote was taken:  Alderperson Meinen, aye; Hofmann, aye; Jones, aye; Koehler, aye.

            Offer to purchase for industrial land.

Alderperson Meinen made a motion to come out of closed session as authorized by Wis. Stats. 19.85 (1) (e).  Alderperson Koehler seconded the motion and a roll call vote was taken:  Meinen, aye; Hofmann, aye; Jones, aye; Koehler, aye.

Alderperson Jones made a motion to authorize the City Attorney to make a counter offer to a potential buyer for industrial land based on the negotiation strategy discussed in closed session.  Alderperson Koehler seconded the motion and all present voted aye.

Alderperson Meinen made a motion to adjourn the meeting.  Alderperson Jones seconded the motion and all present voted aye.
