Pursuant to due call and notice thereof a public hearing of the Common Council of the City of Bloomer was called to order on Wednesday, July 22, 2015 – 6:00 p.m. The hearing was opened to hear comments for rezoning St. Paul’s Catholic Parish – 1222 Main Street – a parcel of land currently zoned R-2 Two Family Residential & C-2 General Commercial District to C-1 – Central Business District. Alderperson Koehler stated the Planning Commission had reviewed this on July 17, 2015 and were recommending approval. The hearing was closed at 6:02 p.m.
Pursuant to due call and notice thereof a regular meeting of the Common Council of the City of Bloomer was called to order on Wednesday, July 22, 2015 at 6:02 p.m. at City Hall, 1503 Main Street - Mayor Meinen presiding.
Roll call was taken: Mayor Meinen, Alderpersons Meinen, Steinmetz, Hofmann, Koehler, Clerk Stoik and Attorney Beardsley.
All present gave pledge to the flag.
Alderperson Steinmetz made a motion to approve the minutes from the previous meetings (July 8, 2015 & July 11, 2015) as presented. Alderperson Hofmann seconded the motion and all present voted aye.
Alderperson Koehler made a motion to approve all claims against the City and Utilities as presented. Alderperson Meinen seconded the motion and all present voted aye. The claims were in the amounts listed below:

Jerry Johnson, Town of Woodmohr questioned if the ETZ meeting had been rescheduled. Mayor Meinen and Clerk Stoik reported the date has been set for August 27, 2015 at Bloomer Middle School.
Alderperson Hofmann made a motion to adopt Ordinance 15 – 03 – To Amend the Official Zoning Map - To Rezone property of St. Paul’s Catholic Parish, 1222 Main Street from (R-2) Two Family Residential & (C-2) General Commercial District to (C-1) Central Business Zoning District. (Certified Survey Map#4401 – Being all of Lot 1, Block 4 Assessor’s Plat, Amodt Add. in the SW – ¼ of the SW – ¼ of Section 4, Township 30North, Range 9West, City of Bloomer, Chippewa County, Wisconsin.) Alderperson Steinmetz seconded the motion and all present voted aye.
A hearing was opened for Samantha Frazier regarding the denial of her application for an Operator’s license that was denied at the July 8, 2015 meeting. Police Chief Zwiefelhofer stated after review of convictions against her, she scored 15. This is above the cut-off for allowing for issuance of an operator’s license. She had a license in the past with the City. Since the last issue date she has been convicted of an OWI and two disorderly conducts. Ms. Frazier stated this is her only job and only source of income. Marty Loew, her employer stated she is a good employee and has worked for him for over a year. Hearing was closed. Alderperson Koehler made a motion to approve an Operator’s License for Samantha Frazier with a one year probation period. If Ms. Frazier violates any of the listed guidelines, Police Chief Zwiefelhofer can suspend her license immediately. Alderperson Steinmetz seconded the motion and all present voted aye.
Alderperson Meinen made a motion to approve Ordinance 15 - 04 To Declare a Moratorium on Siting of Nonmetallic Mining Processing or Transportation Facilities Pending Exploration of the Advisability of Adopting Additional Zoning, Subdivision, or Police Power Regulations. Alderperson Koehler seconded the motion and all present voted aye. The Common Council requested for the next agenda of adopting a moratorium in the ETZ area.
Discussion was held regarding requirements for fencing around retention ponds. Alderperson Meinen requested this at the last meeting. He has received complaints regarding one that is deep located on 16th Avenue. Attorney Thiel drafted a proposed ordinance for review. Mr. Meindel questioned the proposed wording and the difference between retention/detention ponds. Is the City requiring property owners to fence areas that have no water in the pond? Attorney Beardsley was not familiar with the draft submitted by Attorney Thiel. Mr. Meindel suggested tabling action on this issue until he could get in contact with Attorney Thiel to discuss some of these issues.
The Common Council reviewed a possible draft ordinance regarding feeding of ducks and an email received from a property owner requesting the Council take action. Discussion was held regarding possible enforcement of the ordinance and also what does the DNR regulate. No action was taken at this time.
Alderperson Steinmetz made a motion to approve the low quote of $3,500 from RAT Construction for replacement of sidewalk, curb & gutter at SE corner of 15th Avenue & Oak Street. Alderperson Hofmann seconded the motion and all present voted aye.
Alderperson Hofmann made a motion to approve Resolution 1135 – Compliance Maintenance for the Wastewater Treatment Plant Facility – 2014 as presented by Michael Meindel. Alderperson Koehler seconded the motion and all present voted aye.
Item # 14 – Application for a Beer Garden License for Bloomer Brewery: No action is required by the City on advice of Attorney Thiel. They would get this license from the State of Wisconsin.
Alderperson Hofmann made a motion to approve Sue Stoik to attend the Municipal Treasurers Conference on September 24 & 25 in LaCrosse, WI. Alderperson Meinen seconded the motion and all present voted aye.
Alderperson Steinmetz made a motion to approve applications for licenses to serve fermented malt beverages & intoxicating liquors to the following listed below as approved by Police Chief Zwiefelhofer. Alderperson Meinen seconded the motion and all present voted aye.

Peter Paulson, Electric Administrator reported the recently hired meter reader has resigned for the Utilities. He questioned if an ad had been placed in the Bloomer Advance. Clerk Stoik reported it had been advertised. He also stated the City should review the need for sidewalk on the north side of 17th Avenue. After much discussion, Mayor Meinen suggested this to be referred to the Planning Commission and Mr. Meindel for review. He also reported he would be gone starting the first week in August for 6 weeks for surgery. Tim Kuhn will be in charge in his absence.
Michael Meindel, Street, Water & Sewer Administrator reported he had received quotes for blacktopping the old club house on the golf course. The American Legion will be reimbursing the city for the cost. This will be on the next agenda for approval. He also updated the Council regarding programs for dealing with the Emerald Ash Borer. He needs to have a survey done of all the existing trees in the boulevard. He has contacted the school agriculture department and they are interested in assisting with this. He also will be budgeting money for 2016 to start a removal process. This may become an expensive project for the City. Alderperson Steinmetz reported he had received a call and there currently isn’t a garbage can by the handicapped dock. Mr. Meindel will check into this. He also received a complaint regarding high weeds along the railroad at the intersection of 9th Avenue and Main Street.
Tony Rubenzer, Zoning Administrator/Building Inspector – no comments.
Police Chief Jared Zwiefelhofer – no comments. Alderperson Koehler questioned the ordinance regarding recreational vehicles parked on the street. Police Chief Zwiefelhofer reported this is allowed according to the ordinance.

Alderperson Hofmann - no comments.
Alderperson Steinmetz – no comments.
Alderperson Koehler questioned Tony Rubenzer regarding the trailer home located on 7th Avenue and the date required for removal. Mr. Rubenzer stated the date for removal is August 28, 2015.
Mayor Meinen – no comments.
Alderperson Steinmetz made a motion to go into closed session as authorized by Wis. Stats. 19.85 (1) (e) as read by Mayor Meinen. Alderperson Meinen seconded the motion and a roll call vote was taken: Meinen, aye; Hofmann, aye; Steinmetz, aye; Koehler, aye.
Alderperson Meinen made a motion to come out of closed session and report on action taken. Alderperson Steinmetz seconded the motion. No action was taken.
