MEETING MINUTES

Bloomer, Wisconsin

                                                                          July 24, 2013

Pursuant to due call and notice thereof a public hearing of the Common Council of the City of Bloomer was opened for the City to declare police powers under Section 66.0703 of the Wis. Stats. – 2013 8th Avenue Reconstruction Project. The hearing was opened at 6:31 p.m. Michael Meindel, Street, Water & Sewer Administrator explained the project.  This will complete 8th Avenue to meet up with the new elementary school.  The plans called for standup curb.  He had received a request from a property owner on the south side to place drive over curb.  He checked into costs and this would add $650 to the costs.  He doesn’t want to see different curbs for each property.  No one appeared at the hearing. The hearing was closed at 6:33 p.m.

Pursuant to due call and notice thereof a regular meeting of the Common Council of the City of Bloomer was called to order on the above date at 6:33 p.m. at City Hall – Mayor Summerfield presiding.

Roll call was taken:  Mayor Summerfield, Alderpersons Meinen, Hofmann, Steinmetz, Koehler, Clerk Stoik and Attorney Thiel.

All present gave pledge to the flag.

Alderperson Steinmetz made a motion to approve the minutes from the previous meeting (July 10, 2013) as presented.  Alderperson Hofmann seconded the motion and all present voted aye. 

Alderperson Meinen made a motion to approve all claims against the City and Utilities as presented.  Alderperson Koehler seconded the motion and all present voted aye. The claims were in the amounts listed below:

AUDIENCE COMMENTS

Tom Zwiefelhofer, owner of property at 1916 17th Avenue stated at the last Council meeting Attorney Thiel referred to Ordinance 13-1-200(k) – Outdoor Lighting.  It states the light pole shall be no more than 15 feet in height and no more than .5 candles.  They measured the light and the pole is over 22 feet in height.  They also had the brightness measured and in their yard it measured 8.8; bedroom – 3.9; interior of the house 1.2.  They are requesting the light to be turned off.  They feel it is a public nuisance.  Who enforces the ordinance?  Attorney Thiel responded that it usually was on a complaint basis and it would be the responsibility of the Zoning Administrator. 

Alderperson Koehler made a motion to approve Final Resolution 1111 - Authorizing – Street, Curb & Gutter & Storm Sewer Improvements & Levying Special Assessments Against Benefitted property for the 8th Avenue Reconstruction Project from Ivy Street east approx. 950 feet. Alderperson Meinen seconded the motion.  Discussion:  Alderperson Hofmann questioned Mr. Meindel regarding box curb vs. driveway.  Mr. Meindel recommended proceeding with the proposed plans that were bid out. All present voted aye.

Alderperson Hofmann made a motion to approve a Conditional Use Permit for Michael Randall, 18887 State Highway 40, Town of Woodmohr to allow RV parking and camp ground in the ETZ zoning area as recommended by the ETZ Committee and Planning Commission.  Alderperson Steinmetz seconded the motion and all present voted aye.

Discussion was held regarding the Planning Commission that was held prior to the Council meeting regarding fencing between the Zwiefelhofer property at 1916 17th Avenue and Dennis Schwab property at 2000 17th Avenue.  Mayor Summerfield reported the results of the Planning Commission.  This had been approved in 2004. After discussion, Alderperson Meinen made a motion to approve the recommendations of the Planning Commission regarding the fence installation between the two properties: Zwiefelhofer’s at 1916 17th Avenue and Dennis Schwab’s at 2000 17th Avenue. Alderperson Steinmetz seconded the motion and a roll call vote was taken:  Alderperson Meinen, aye; Hofmann, aye; Steinmetz, aye; Koehler, aye.  The recommendations to install the fence are as follows:

            The fence will be 6 feet high.

            The fence will be placed 10 feet from the property line.

            The fence will start 10 feet south of the 17th Avenue property line approximately 195 feet to connect to the south fence. 

Alderperson Meinen made a motion to approve an extension of a Class “B” Combination Beer & Liquor license and street closing for Z-Bro, LLC dba Harm’s Way Bar & Grill, 1103 15th Avenue for a street dance on August 23, 6:00 p.m. to August 25, 12:00 p.m. with live music on August 24, 2013 from 11:00 a.m. to August 25, 2013 at 1:00 a.m. as approved by Police Chief Zwiefelhofer.  Alderperson Hofmann seconded the motion and all present voted aye.

Alderperson Hofmann made a motion to approve Ordinance 13-02 – to Renumber Section 8-3-3 and to Create Section 8-3-2 of the City Code; Waste Collection.  Alderperson Steinmetz seconded the motion.  Mr. Meindel stated this will allow the City to control haulers that want to come into the City. All present voted aye.

Alderperson Hofmann made a motion to approve installation of an air conditioner in the training center/office of the Fire Station – for approx. $1,500 from the building fund.  Alderperson Steinmetz seconded the motion.  Alderperson Meinen questioned if this project had been bid out?  Fire Chief Bleskacek stated no.  Roll call vote:  Alderperson Meinen, no Hofmann, aye; Steinmetz, aye; Koehler, aye.  Alderperson Meinen stated he voted no because he feels projects should be bid.  Fire Chief Bleskacek stated he will receive donated labor and electrical for the installation.  The fire department only had to pay for the compressor and materials.  The cost will be deducted from the fire station building fund.

Alderperson Hofmann made a motion to approve changing the date of the August 28, 2013 meeting to August 26, 2013. Alderperson Koehler seconded the motion and all present voted aye.

Alderperson Steinmetz made a motion to approve Renee Mullen to attend Civic Systems Annual Symposium on Sept. 19-20, 2013 in Madison.  Alderperson Hofmann seconded the motion and all present voted aye.

Alderperson Hofmann made a motion to approve the applications for a license to serve fermented malt beverages and intoxicating liquors for the following listed below as approved by Police Chief Jared Zwiefelhofer.  Alderperson Steinmetz seconded the motion and all present voted aye.

DEPARTMENT HEADS

Police Chief Jared Zwiefelhofer reported they are almost completing the hiring process for a part-time officer.  They will be recommending hiring 2 officers at a future meeting.

Michael Meindel, Street, Water & Sewer Administrator reported the head and block are cracked on the cardboard truck.  Estimated cost for repairs will be $17,500.

Peter Paulson, Electric Administrator reported they are back working at the substation.

Clerk Stoik requested RSVP’s for the upcoming joint area meeting on July 31, 2013.

Tony Rubenzer, Zoning Administrator-Building Inspector requested guidance from the Council and Attorney Thiel regarding the height of lights according to the ordinance.  He feels there are numerous light not in compliance.

Alderperson Steinmetz made a motion to adjourn the meeting.  Alderperson Koehler seconded the motion and all present voted aye.
