MEETING MINUTES

Bloomer, Wisconsin

                                                                               June 24, 2015

Pursuant to due call and notice thereof a public hearing of the City of Bloomer was called to order on Wednesday, June 24, 2015 at 6:00 p.m. to hear public comment regarding the rezoning of property owned by the City of Bloomer – Iron Horse Industrial Park – Lots 6, 101, 102, 103 & 104 from (R-1) Single Family Residential to (R-2) Two Family Residential as recommended by the Planning Commission. Alderperson Koehler reported on the Planning Commission meeting held on June 17, 2015. Adjoining property owners had appeared and reviewed the proposed rezoning plan. Alderperson Koehler explained that the City recently replatted 5 lots to 4 to accommodate a wider construction on these lots. The hearing was closed at 6:02 p.m.

Pursuant to due call and notice thereof a regular meeting of the Common Council of the City of Bloomer was called to order on Wednesday, June 24, 2015 at 6:02 p.m. at City Hall, Mayor Meinen presiding.

Roll call was taken: Mayor Meinen, Alderpersons Meinen, Steinmetz, Hofmann, Koehler, Clerk Stoik and Attorney Beardsley.

All present gave pledge to the flag.

Alderperson Steinmetz made a motion to approve the minutes from the previous meeting (June 10, 2015) as presented. Alderperson Hofmann seconded the motion and all present voted aye.

Alderperson Koehler made a motion to approve all claims against the City and Utilities as presented. Alderperson Meinen seconded the motion and all present voted aye. The claims were in the amounts listed below:

AUDIENCE COMMENTS

Cecelia Stencil, 2720 9th Avenue informed the Council the ad the City uses in the newspaper for sale of the residential lots doesn’t meet what the actual covenants state. The Council thanked her for the information and will get the ad corrected for future advertisements. Tom Brodt, 2640 9th Avenue questioned if there were any pending rezoning applications. No applications are pending at the current time.

Alderperson Hofmann made a motion to approve Ordinance 15 – 02 to approve rezoning 5 lots owned by the City of Bloomer in Iron Horse Industrial Park (lots 6, 101, 102, 103 & 104) from (R-1) Single Family Residential to (R-2) Two-Family Residential as recommended by the Planning Commission. Alderperson Steinmetz seconded the motion and all present voted aye.

Alderperson Hofmann made a motion to approve payment of $50,446.36 to A-1 Excavating for the 6th Avenue Reconstruction – LRIP Project. Alderperson Meinen seconded the motion and all present voted aye.

Discussion was held with Doug Nelson, Labor Consultant from Labor Association of Wisconsin – Police Union and Mark McElroy, Grievant regarding Grievance 15-7 filed by them regarding Article III – Jurisdiction of Work; Article X111 – Overtime/Compensatory Time field on May 14, 2015. Step 1 – The union, grievant, Mayor and Council President met to review the grievance. No action was taken. It was agreed by both parties to move it to Step 2. Step 2 is review by the Common Council. No action was taken by the Council. A letter will be sent to LAW within 5 days as stated in the contract.

Discussion was held regarding a 13th Avenue encroachment of a building into the city right-of-way. Tony Rubenzer explained that a recent sale of property located at 1300 Main Street showed that the north edge of the building encroached on the City right-of-way. The Council reviewed a letter sent by Attorney Thiel giving options and legal advice on what to do to solve the issue. The Council felt this was an issue between the buyer and seller. But, after review with Attorney Beardsley the following motion was presented. Alderperson Koehler made a motion to approve a revocable license to the property at 1300 Main Street for the encroachment. Alderperson Hofmann seconded the motion and all present voted aye.

Alderperson Steinmetz made a motion to approve the low quote of $7,297.08 from Perfection Paving for crack sealing in 2015. Alderperson Koehler seconded the motion and all present voted aye.

Alderperson Steinmetz made a motion to approve Resolution 1133 – To Authorize Mayor and City Clerk to Execute Tweed Exchange Holdings, LLC to Lot 202, Iron Horse Industrial Park. Alderperson Hofmann seconded the motion and all present voted aye.

Alderperson Meinen discussed with the Council to put more restrictions on property zoned Industrial in the City that would restrict certain operations. After discussion, the Council decided to refer this to the Planning Commission for review and possible changes. If changes are made to the zoning code, a public hearing will need to be held before the Council can take action to amend the zoning code.

No action was taken regarding the Joint Cities Meeting in Osseo. It has been cancelled.

Alderperson Hofmann made a motion to approve applications for licenses to serve fermented malt beverages & intoxicating liquors to the following listed below as approved by Police Chief Zwiefelhofer. Alderperson Meinen seconded the motion and all present voted aye.

DEPARTMENT HEADS

Clerk Stoik – no comments.

Police Chief Jared Zwiefelhofer reported the department is participating in a speed enforcement grant with the State of Wisconsin Task Force on State Highway 53. The City will be reimbursed for their efforts in assisting the State of Wisconsin.

Tony Rubenzer, Building Inspector/Zoning administrator stated he has not received any calls from the property owner regarding the letter sent regarding the condition of a building.

Peter Paulson, Electric Administrator – was not present.

Michael Meindel, Street, Water & Sewer Administrator – was not present.

ALDERPERSON COMMENTS

Alderperson Steinmetz – no comments.

Alderperson Koehler informed the Council the Lake Como Community Trail organization has received approval for the first stage of developing the trail in the City. He requested this to be placed on the next agenda.

MAYOR COMMENTS

Mayor Meinen – no comments.

Alderperson Steinmetz made a motion to go into closed session as authorized by Wis. Stats. 19.85 (1) (c) (e) as read by Mayor Meinen. Alderperson Koehler seconded the motion and a roll call vote was taken: Meinen, aye; Hofmann, aye; Steinmetz, aye; Koehler, aye.

Alderperson Steinmetz made a motion to come out of closed session and report on action taken. Alderperson Koehler seconded the motion and all present voted aye.

Alderperson Koehler made a motion to approve increasing Nicholas Hutchinson, Part-time Officer pay to $16.00 effective 07-01-15 and to $16.50 effective 01-01-16. Alderperson Steinmetz seconded the motion and all present voted.

Alderperson Meinen made a motion to approve changes to the Employee Handbook (Page 17 & 39– correction of typographical errors; Page 21 – insert language regarding accumulation of sick leave hours for electric employees. Alderperson Hofmann seconded the motion and all present voted aye.

Alderperson Steinmetz made a motion to adjourn the meeting. Alderperson Koehler seconded the motion and all present voted aye.
